Middleton Man Held on Felony Assault and Threatening Charges

On 07-27-2013, at 7:12 p.m. members of the Middleton and Milton Police Departments responded to the area of 702 Route 153 for a reported assault involving a baseball bat.

Upon arrival, members of the police department observed an assault in progress.  The parties were seperated, medical attention was provided and an investigation ensued.

Members of the Middleton Fire and Rescue and Paramedics from Frisbie Memorial Hospital responded. 

As a result of injuries sustained in an assault, a 50 year old neighbor was transported to Frisbie Memorial Hospital where he was admitted overnight with serious injuries.  The victim has since been released from the Hospital.  Middleton Police are not releasing the victim's name or nature of those injuries because of federal privacy laws. 

As a result of the investigation, Middleton Police applied for and were granted an arrest warrant charging:

with second degree assault for knowingly engaging in the strangulation of another and criminal threatening with a deadly weapon by physical conduct in that he did purposely attempt to place another in fear of imminent bodily injury by holding a cinder block above the head of the victim and stating that he was going to kill him.
 
Mr. Roche was arrested without incident at 07/28/2013 at 0220 a.m. and was cooperative during the arrest process.  Milton Police provided support during the arrest process.
 
Mr. Roche was transported to the Strafford County Jail in Dover, New Hampshire for processing.  Bail was set at $50,000 cash bail.  Mr. Roche will be arraigned in the 7th Circuit Court, Rochester on Monday, July 29th at 11:00 a.m.
 
Both Charges before the Court are Class B felonies punishable by 3.5 to 7 years in the New Hampshire State Prison. 
 
At this point no additional information is being released.  The investigation is being forwarded to the Office of the Strafford County Attorney who will decide what if any additional charges will be filed.  The Office of the Strafford County Attorney was consulted and provided assistance during this investigation.
